About these terms
These terms are between you and Daryl Bleach, trading as On The Day (“we”), for using On The Day Journal (“the Journal”). Contact: hello@ontheday.app. Postal address: [TO ADD].
By creating an account you agree to these terms. Please also read our privacy notice.
What the Journal is, and isn’t
The Journal is a personal diary and record-keeping tool. It helps you keep track of your medicines, how you feel and your appointments, and turns your diary into a summary you can share.
It is not a medical device and does not give medical advice. It does not diagnose, recommend or change doses, or tell you whether to take a medicine. Patterns and the side-effect watch only describe what you have written, as things that may be worth mentioning to your GP or pharmacist.
Always follow the advice of your GP, pharmacist or other health professional. In an emergency, call 999. For urgent help that isn’t an emergency, call NHS 111.
Reminders depend on your phone, its settings and its internet connection. Please don’t rely on them alone for medicines where a missed dose could be serious.
Your account
- You must give accurate details and keep your password safe.
- You are responsible for what is done with your account, including by helpers you invite.
- If someone set up your account for you, it becomes yours when you take it over with your own password.
- One account is for one person.
Plans and payment
- Every new account includes a 30-day free trial of all features. No card is needed.
- After the trial you can stay on the free plan, or pay for Journal (£2.99 a month or £24.99 a year) or On The Day plus Journal (£6.99 a month or £69.99 a year). Prices include VAT.
- Paid plans renew automatically until you cancel. You can cancel at any time in the app, and keep your paid features until the end of the period you have paid for.
- Cooling-off: you can cancel within 14 days of first paying and get a full refund. [TO CONFIRM: wording under the Consumer Contracts Regulations, since the service starts straight away]
- If we change prices, we will tell you at least 30 days before, and you can cancel before the new price applies.
- If you stop paying, nothing is deleted. You move to the free plan.
Your content
Everything you write in the Journal belongs to you. You give us permission to store and process it only to run the Journal for you, as described in the privacy notice. You can download it or delete it at any time.
Fair use
Please don’t misuse the Journal: for example, trying to get into other people’s accounts, overloading the service, or using it for anything unlawful. We may suspend an account that does this, and will tell you why unless the law stops us.
Availability and changes
We work hard to keep the Journal running and your data safe, but we can’t promise it will always be available or free of faults. We may improve or change features. If we ever close the Journal, we will give you at least 60 days’ notice and the chance to download everything.
Our responsibility to you
- We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill.
- We are not responsible for loss that isn’t foreseeable, or for decisions made using the Journal instead of professional advice.
- Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t allow us to limit.
- Your legal rights as a consumer are not affected.
Ending your account
You can delete your account at any time in Settings. We may close an account that breaks these terms, after telling you why (unless the law prevents it), and you can still download your data first.
Law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
Changes to these terms
We will tell you about important changes at least 30 days before they apply.
